SRI MICHAEL SADANANDA BAPTIST Vs. STATE

JUDGEMENT

(1.) On 9/8/2019, a complaint was presented before the Magistrate under Sec. 200 of the Criminal Procedure Code, 1973 ("the CrPC") alleging commission of offences under Sec. 406 r/w 34 of the Indian Penal Code, 1860 ("the IPC") against Bishop Dr. T. Anthony Swamy and Father A. Shantharaj.

(2.) The complainant was a member of the governing body of St. Joseph Education Society, Chikkamagaluru, ("the Society") a Society registered under the provisions of the Mysore Societies Registration Act, 1960.

(3.) It was contended that Bishop Dr. T. Anthony Swamy was the President of the St. Joseph Education Society and also the Bishop of the Chikkamagaluru Diocese, and Father A. Shantharaj was the Vice President of said Society and was incidentally also the Vicar General of the Diocese, Chikkamagaluru.
