JUDGEMENT

(1.) Appellant who is arraigned as accused No.1 has filed this appeal under Sec. this petition filed under Sec. 439 of Code of Criminal Procedure (for short, 'the Cr.P.C.') (483 of BNSS), seeking regular bail in Crime No.88/2024 for the offences punishable under Sec. 420 of IPC and Sec. 3(2)(va) of SC/ST Act 2015.

(2.) In support of the appeal, the appellant has contended that there is no prima facie case made out against the appellant. He was in live in relationship with the complainant and the same is converted as a case of cheating. The complaint averments, statement of complainant under Sec. 164 of Cr.P.C. and her further statement contradict each other. Appellant has no criminal antecedents. The alleged offences are not punishable with death or imprisonment for life. No justifiable reasons are given by the Trial Court for rejecting his bail application. Already charge sheet is filed and as such, the custodial presence of the appellant is not required. He is permanent resident of the address given in the cause title.

(3.) He is ready and willing to abide by any conditions that may be imposed and offer substantial surety to the satisfaction of the trial Court and pray to allow the appeal.
