(1.) THE appellant (accused) was tried for an offence punishable under Section 307 IPC. The accused has been convicted for an offence punishable under Section 326 IPC. Therefore, he is before this Court.
(2.) THE learned counsel for the appellant is absent. The accused is on bail. In Criminal Appeal No.1680/2013 (dated 7.10.2013 in the case of SURYA BAKSH SINGH vs. STATE OF UTTAR PRADESH), the Supreme Court has held thus:
