JUDGEMENT

(1.) HEARD Shri Anant R. Hegde, learned counsel appearing for petitioners and Shri P.N.Hatti, learned counsel appearing for respondents. Perused the case papers including statement of objections filed by respondents.

(2.) PETITIONERS are seeking for a mandamus to direct the respondents to pay interest on the compensation paid to petitioners from the date of Section 3(1) notification issued under KIADB Act on 19.08.2006 till date of payment of compensation at the rate of 9% p.a. for the first year and at the rate of 15% p.a. for second year onwards from the date of determination till date of payment or in the alternative, they are seeking for a direction to consider the representation of petitioners dated 13.03.2013 Annexures W to W4.

IT is not in dispute that respondent No.1 had issued notification under Section 28(4) of the KIADB Act published on 06.10.2007 to acquire land to an extent of 17 acres 28 guntas at Tarihal Village, Hubli Taluk, Dharwad District. Undisputedly, lands of petitioners have also been included in said acquisition proceedings. An agreement is said to have been executed between erstwhile land owners and KIADB during the year 2008, agreeing thereunder to receive compensation as determined by the Price Advisory Committee under the Chairmanship of Deputy Commissioner, as per the provisions of Section 29(2) of the KIADB Act, 1976 and accordingly, price fixed by said Committee by determining compensation payable per acre has been approved by the Competent Authority.
