JUDGEMENT

(1.) THE Union of India has filed this writ petition, challenging the legality and the correctness of the order passed by the Central Administrative Tribunal, Bangalore Bench, Bangalore on 19 -3 -2012 in Original Application No 404 of 2009.

(2.) HEARD Sri Masilamani, learned Additional Solicitor General appearing for the petitioners and Sri A R Holla, the learned counsel for the respondent.

(3.) THE Original Application was filed by the respondent to quash the order in F No 1/23/2008 -M.II dated 16 -1 - 2009, issued by the Union of India, in so far as it relates to restricting the benefit conferred by the OM dated 6 -6 -2000 to the officers with effect from 16 -1 -2009 only, and to extend the benefit of promotion to non -functional selection grade [NFSG] and the pay scale of Rs 14300 -400 -18300 to the applicant in terms of the OM dated 6 -6 -2000 with effect from 1 -1 -2003 and also to extend all consequential benefits.
