JUDGEMENT

(1.) THESE criminal petitions are filed under Section 439 of the Cr.P.C. praying to enlarge the petitioner on bail in Cr. No.123/13 of Ijoor P.S., Ramanagara and in C.C. No. 98/13 and 99/13 on the file of the C.J.M., Ramanagara, for the Offences P/U/S 417, 418, 465, 468, 471, 409, 477(A), 167, 120(B), 420 R/W 34 of IPC, etc.

(2.) THE petitioner -accused No.1 has filed the present petitions under Section 439 of Cr.P.C. seeking his release on bail of the offences punishable under Sections 409, 420, 468, 471 read with Section 34 of IPC registered in respondent Police Station Crime No.123/2013.

BRIEF facts of the case as per the averments made in the petition are that it is alleged in the complaint that on 16.7.2013, the complainant visited the office of the accused as per the order of the D.C. Ramanagar. She verified about the transfer of Rs.9.90 crores from Vijya Bank, Ramanagar and ICICI Bank, Malleshwaram Branch, Bangalore to Indian Bank, M.C. Branch, Mandya, by the petitioner herein in his capacity as Commissioner, Ramanagara -Chennapatna Urban Development authority. It is further alleged that, upon verification, the complainant found that from the Vijaya Bank account, a total amount of Rs.9.5 crores were transferred to Indian Bank, Mandya on various dates through 10 different cheques and Rs.40 lakhs from ICICI Bank, Malleshwaram, Bangalore, to Indian Bank, Mandya. Vide letter dated 13.7.2013, the Manager of the Indian Bank, Mandya has given a report stating that there is no such deposit of any amount in their bank made by the petitioner herein. The documents revealed that the said amount was deposited with Indian Bank as fixed deposit and on those documents from the Bank side, there are signature of persons by name B. Kundri and Ramaswamy. The complainant has also stated that she perused a letter dated 24.3.2013 wherein the Indian Bank, Mandya, induced to give more interest on different fixed deposit. Based on the said complaint, case has been registered against the petitioner and also the other accused persons.
