AKASH KUMAR S. Vs. STATE

JUDGEMENT

(1.) The petitioners are seeking anticipatory bail in crime No.22/2023 of Nagamangala Town Police Station registered against them as well as three others for the offence punishable under Ss. 143, 504, 323, 324, 147 and 307 r/w Sec. 149 of IPC.

(2.) Petitioners are arraigned as accused Nos.1, 2 and 5 respectively. In the complaint lodged by one Madhu S/o. Basavaraju, it is alleged that on 22/2/2023 at 8.00 a.m., he had returned from Bengaluru in a Toyata Etioz car bearing registration No.KA-04-AA-9377 and on that night he had gone to SJB lodge along with his friends Nagaraju and Vivek. While taking the car reverse, the accused persons came and started quarrelling with him. They abused him in filthy language and assaulted with ripper patti and kicked him etc. They also assaulted him on his head and assaulted Nagaraju and Vivek with the same ripper patti, etc.

(3.) The injured took treatment at Nagamangala Government Hospital and from there they were shifted to A.C. Giri hospital in B.G. Nagar for higher treatment. Complainant's statement was recorded by the police in the said hospital. On the next day i.e. on 23/2/2023, his further statement was recorded.
