DHARAMAPPA Vs. STATE OF KARNATAKA

JUDGEMENT

(1.) This petition is filed under Sec. 439 of Cr.P.C to enlarge the petitioner on bail in Crime No.189/2022 of Munirabad police station, Koppal, registered for offences punishable under Ss. 302 and 201 of IPC.

(2.) Heard both the sides and perused the material on record.

(3.) It is alleged by the prosecution that the accused/ petitioner with an intention to grab the entire property belonging to his wife's mother, hatched a plan to commit the murder of his wife's brother namely Lingaraj and on 8/7/2022 at about 7:30 p.m., took him in his Mahindra vehicle bearing No.KA-37/B-3641 to a secluded place on MSBL road and then asked him to get down from the vehicle and hit him with the vehicle and committed his murder. Thereafter he hid the dead body in the bushes and returned to his house. Once again on 9/7/2022 at 4:30 p.m., he went to the spot and took the dead body in the vehicle towards Tungabhadra Dam and dumped the dead body near the canal, to cause disappearance of the evidence.
