(2.) This Criminal Revision Petition is filed challenging the Order passed in C.C.No.143/2015 on the file of Principal Civil Judge and JMFC, Kunigal, dtd. 11/9/2018, confirmed in Criminal Appeal No.60/2018 on the file of I Additional District and Sessions Judge, Tumakuru, dtd. 4/12/2019.

Facts in brief are as under: The Revision Petitioner faced the trial in respect of dishonoured cheque for the offence punishable under Sec. 138 of the Negotiable Instruments Act ('Act' for short). The case of complainant is that the Revision Petitioner/accused borrowed Rs.2,50,000.00 and failed to repay the said sum and therefore, issued cheque after repeated demands which, on presentation, came to be dishonoured and there was no compliance to the statutory legal notice resulting in commission of offence by the Revision Petitioner for the offence punishable under Sec. 138 of the Act and prosecution was launched against the Revision Petitioner.
