(1.) Since these three writ petitions raised a common issues, the three petitions were clubbed, heard together and are disposed of by this common order.
(2.) The petitioners herein are qualified doctors who have established medical clinics and have been functioning in the said clinics. One of the petitioners was visited with the notices at the hands of the respondent-Medical Officer. In the other two cases, it is contended that because the Health officer of the BBMP insisted that the petitioners have to obtain a trade licence for establishing and running a clinic, two petitioners obtained a trade licence. One such petitioner is seeking a declaration that there is no need for securing a trade licence to establish and run a medical clinic.
(3.) In another petition, the petitioner contends that after issuing the trade licence, the trade licence was cancelled on the ground that the width of the road abutting the building is less than 40 feet and therefore, such clinics/commercial establishments cannot be permitted in a residential area.
