(1.) The petitioners are before this Court calling in question registration of crime in Crime No.133 of 2022, pending before the 3rd ACMM Court, Bengaluru, for offences punishable under Ss. 498A, 354 and 34 of the IPC and Ss. 3 and 4 of the Dowry Prohibition Act, 1961.
(2.) Heard Sri K.S.Karthik Kiran, learned counsel appearing for the petitioners, Sri Mahesh Shetty, learned High Court Government Pleader for respondent No.1 and Sri B.A. Chandrashekar, learned counsel appearing for respondent No.2.
(3.) Brief facts that lead the petitioners to this Court in the subject petition, as borne out from the pleadings, are as follows:- The petitioners are accused Nos.1, 2 and 3. In relation, the 1st petitioner is the husband and the 2nd petitioner is the father-in- law of the 2nd respondent/complainant and the 3rd petitioner is the aunt of accused No.1. The 1st petitioner and the 2nd respondent get married on 24/11/2021. Soon after the marriage, it appears, the relationship between the 1st petitioner and the 2nd respondent begins to flounder. On such floundering of relationship, the proceedings against each other are sought to be initiated. The 2nd respondent registers a complaint before the jurisdictional police on 20/5/2022 barely after 6 months of marriage alleging harassment and torture both by the father-in-law, husband as well as the 3rd petitioner, the aunt of the 1st petitioner. The complaint then becomes a crime in Crime No.133 of 2022 for offences punishable under Sec. 498A, 354 and 34 of the IPC. The registration of the crime is what drives the petitioners to this Court in the subject petition.
