JUDGEMENT

(1.) The petitioner is calling in question the endorsement dtd. 21/9/2020, by which, the claim of the petitioner to be considered as Lab Assistant has been refused on the ground that the petitioner would be entitled to be considered for promotion only to the post of Driver (heavy vehicle).

It is the case of the petitioner that C and R Rules of the University provide for the post of Field Assistant/Lab Assistant/Stockmen/ Assistant School Teacher/Graduate Technician to be filled up either by direct recruitment or from promotion from the employees of the University, who had a minimum experience of five years and had been working in the payscale of 1040-1900.

(3.) It is the further case of the petitioner that the payscale of 1040-1900 stipulated in the C & R Rules, for considering promotion to the post of Field Assistant/Lab Assistant, is only referable to one post i.e., Driver (light vehicle).
