JUDGEMENT

(1.) Heard on bail application.

(2.) On the basis of the complaint filed by one Sripal S/o Mahendra Jain, S.J.Park Police Station, Bengaluru have registered a case in Crime No.39/2023 against accused for the commission of offences punishable under Ss. 408, 506 R/w Sec. 34 of Indian Penal Code (hereinafter referred as I.P.C .), pending on the file of III-Addl. Chief Metropolitan Magistrate Court, Nrupatunga Road, Bengaluru City.

The brief facts of the complaint is that the father of the complainant is having shop under the name and style as "Seemtrans Sales Corporation" located at No.12, M.M.Lane, SJP Road, Bengaluru and was doing business of pump-set and cables since 44 years and the complainant was also looking after the business along with his father, and complainant was having 7 employees, out of which accused No.1 and 2 were working as Godown in-charge, such being the case, in recent days, due to ill-health, the father of the complainant was under rest. During such period, the accused persons alleged to have been misappropriated the stock and hence, the complainant and his father checked the stock on 28/2/2023 and found missing of stock worth Rs.28,00,000.00. Thereafter, the complainant and his father enquired the accused persons and they threatened with dire consequences. On the basis of the complaint, respondent police registered the case against the accused persons.
