SAROJA Vs. STATE OF KARNATAKA

JUDGEMENT

(1.) This petition is filed under Sec. 439 of Cr.P.C. praying to enlarge the petitioner/accused No.1 on bail in Crime No.178/2022 of Kempapura Agrahara Police Station.

(2.) FIR is registered against unknown persons, after noticing an unidentified dead body of a person lying in-front of house No.15/1, 5th Cross, Magadi Road, Kempapura Agrahara, Bengaluru City. In the course of investigation, the involvement of the petitioner and other accused persons came to light. On completion of investigation, charge sheet is filed against accused Nos.1 to 7 for the offence punishable under Ss. 143, 144, 120B, 147, 148, 302, 323 read with Sec. 149 of the Indian Penal Code, 1860 (hereinafter referred to as ' IPC ' for short).

(3.) It is the case of prosecution that petitioner/accused No.1 was having an illicit relationship with the deceased - Manjunath Balappa Jamakhandi and they had some financial transaction. Since accused No.1 was having illicit relationship with others, the deceased was picking up quarrel with her and in this connection, there were couple of cases registered against the deceased. In this background, all the accused conspired with each other to commit his murder and in furtherance of the conspiracy, on 4/12/2022 at about 12.30 mid night, they secured the deceased near one Hemanth Medicals, Magadi Road, Bengaluru. Accused No.1 and 4 to 7 held him tightly and accused No.2 to 5 hit him with a cement brick on his head etc. and committed his murder.
