JUDGEMENT

(1.) This petition is filed by accused No.2 under Sec. 439 of Cr.P.C. seeking grant of regular bail in Cr.No.212/2022 of Sathanur Police Station, Ramanagara District registered for the offences punishable under Sec. 302 of IPC, now pending in C.C.No.2070/2022 on the file of I Additional Civil Judge and J.M.F.C., Kanakapura.

(2.) The Sathnur Police have registered a case on the basis of the complaint filed by one Dileep, wherein, he had stated that on 19/7/2022 at about 07.30 pm, the accused No.1-Munesh had come to him and informed that his sister Yellamma had died. Therefore, the complainant and another person named Lokesh went to the house of Yellamma and found that she was alive and after scolding the accused No.1, they returned to their house. Thereafter, at about 08.00 pm., the accused No.1-Munesh and the accused No.2-Krishnappa came to the house of complainant and informed that Yellamma had died and therefore, he went to the house of Yellamma and found that she had died and there was a ligature mark around her neck. The accused Nos.1 and 2 did not gave satisfactory reply in respect of the ligature mark and therefore, suspecting that the accused Nos.1 and 2 had committed the murder of the deceased Yellamma, a complaint was lodged before the concerned Police.

The Investigation Officer after the investigation has filed the charge sheet against the accused Nos.1 and 2 alleging that the accused Nos.1 and 2 were fed up with the ill-health of the deceased Yellamma as she had suffered an accident and could not stand up and look after herself. It was alleged that the deceased Yellamma was bedridden and even she could not rise for nature call and the accused Nos.1 and 2 were looking after the said Yellamma and they were fed up with cleaning the deceased Yellamma and therefore, they decided to get rid of her and as such, strangulated her and killed her. It was alleged that the blouse of the deceased Yellamma was used as a ligature. Hence, alleging that the accused Nos.1 and 2 have committed the offence, a charge sheet has been laid before the concerned Court.
