P. LATHA SHYAMA RAJU Vs. P. SHYAMA RAJU

Decided On July 04, 2023
P. Latha Shyama Raju Appellant
V/S
P. Shyama Raju Respondents

JUDGEMENT

(1.) Parties being the estranged couple have been fighting two legal battles against each other: one in M.C.No. 2225/2014 is filed by the Respondent-husband for the dissolution of marriage that was solemnized on 28/6/2007 at Tirumala in Andhra Pradesh and the same is structured inter alia on fault grounds; the other in M.C.No.1027/2019 is filed by the Petitioner-wife seeking a decree for restitution of conjugal rights. There were other off shoot cases between them, and at one stage the matter went to Apex Court of the country, too.

(2.) Both the Petitioner and the Respondent being highly educated & cultured have now entered into a compromise to put a decent end to all the legal battles. Accordingly, this day, they have filed a Joint Compromise Petition supported by their individual affidavits both dated 03 07.2023. The same reads as under:

(3.) I have perused the petition papers and the Compromise Petition. Learned Advocates appearing for the parties are justified in submitting that the settlement between the parties is bona fide and it is in their best interest; there is no legal or factual impediment for recording the compromise and thereby disposing off the aforesaid cases ie., M.C.No.2225/2014 & M.C.No.1027/2019 by dissolving the marriage between the parties. There is absolutely no reason to suspect fraud or duplicity. That being the position, the writ petition also needs to be disposed off, accordingly.
