(1.) The petitioners-accused Nos.1 and 2 is before this Court seeking grant of anticipatory bail in Crime No.363/2022 of K.R. Nagar Police Station, Mysore Rural Sub- Division, pending on the file of IV Addl. District and Sessions Judge, Mysuru registered for the offences punishable under Ss. 504 , 354 , 324 , 307 , 114 , 506 read with Sec. 34 of Indian Penal Code (for short ' IPC '), on the basis of the first information lodged by the informant- Smt. Sakamma.
(2.) Heard Sri. Ravisha M.G. learned counsel for the petitioners and Sri. H.S.Shankar, learned High Court Government Pleader for the respondent-State. Perused the materials on record.
(3.) Learned counsel for the petitioners submitted that the petitioners are arrayed as accused Nos.1 and 2. They are innocent and law abiding citizens. They have not committed any offences as alleged. They have been falsely implicated in the matter without any basis. There is reasonable apprehension of they being arrested. Hence, they are before this Court. He further submitted that the informant lodged FIR against accused Nos.1 to 5 making allegations that, petitioners - accused Nos.1 and 2 were creating nuisance and abusing the informant and her family members and also it is alleged that accused Nos.1 to 3 have assaulted the husband and brother - in - law of the informant with machete, iron rod and club. None of them have sustained injuries. Under such circumstances, the Petitioners are not required for interrogation. They are not having any criminal antecedents. They are the permanent resident of the address mentioned in the cause-title to the petition and are ready and willing to abide by any of the conditions that would be imposed by this Court. He further submits that accused No.4 and 5 have been granted bail by this Court. Hence, on the ground of parity, these petitioners are also entitled to be granted pre-arrest bail. Hence, he prays to allow the petition in the interest of justice.
