(1.) The petitioner being desirous of registering a Co-operative Society has made an application for registration of the same to the 2nd respondent. However, the 2nd respondent has failed to act on the said application. Hence, the instant writ petition is filed on the ground that as per Sec. 7(2) of the Karnataka Co-operative Societies Act, 1959, the byelaws are deemed to have been registered.
(2.) Sec. 6 of the Act states how one has to make an application for registration of Co-operative Society. Sec. 7 of the Act deals with registration of the Society by the Registrar. Sec. 7(2) of the Act, reads as under:
(3.) Thus, if the Registrar is unable to dispose off the application within three months from the date of receipt of the application (time specified in Sec. 7(1) of the Act), the Society and the byelaws shall be deemed to have been registered.
