JUDGEMENT

(1.) Heard both the sides and perused the material on record.

(2.) The petitioner is alleged of illegally mining the sand using a tractor near Tungabadra river, Kumarapattanam at around 11.40 p.m. on 2/11/2022. According to the prosecution, on receiving credible information, Police went to the spot along with two panch witnesses and noticed the petitioner loading the sand into the tractor. On enquiry they found that the petitioner was doing illegal sand mining without any license or permit.

(3.) In the complaint, it is alleged that the petitioner ran away from the spot and further alleged that the tractor and trailer did not have any registration number. About 5 metric tons of sand, worth Rs.5000.00 has been seized along with the tractor and trailer under a mahazar, in the presence of panch witnesses.
