(1.) Heard the learned counsel for the petitioner and learned counsel for the respondents.

The petitioner is before this Court challenging the order dtd. 29/4/2022 passed in Crl.Misc.No.64/2021 on the file of the I Additional Family Judge, Hassan, partly allowing the petition filed under Sec. 125 of Cr.P.C granting maintenance of Rs.4,000.00 per month to the wife and Rs.2,000.00 per month each to the two daughters, who were aged about 7 years and 5 years at the time of filing the petition in 2021.

Learned counsel for the petitioner would submit that the petitioner is a coolie and he is not having definite income and he is not affordable to pay the maintenance of Rs.4,000.00 per month to the wife and Rs.2,000.00 per month each to the two daughters. The counsel also would submit that the order passed by the Trial Court is an exparte order and though the counsel took time twice to produce the document to show that notice was not served on the petitioner, he has not produced any document before the Court.
