GOVARDHAN V. Vs. STATE OF KARNATAKA

JUDGEMENT

(1.) The case of the petitioner is that he is the owner of property bearing Site No.148 in Municipal Nos.6/1 and 6/2 of Vitala Nagara, Kempambudhi Lake Village, (PID No.45/16/148) and that the petitioner has not encroached upon any canal or Government land.

(2.) Respondent No.2 has passed the impugned order bearing No.NCR/K/CR/117/2022-23 dtd. 13/6/2023 (vide Annexure- 'G' to the writ petition), wherein petitioner is not made a party to the proceedings. However, a portion of the building constructed by the petitioner is sought to be demolished on the strength of the impugned order.

(3.) The petitioner submits that if an opportunity is given, he shall satisfy before respondent No.2 that the petitioner has not encroached upon any canal or storm water drain or Government property.
