JUDGEMENT

(1.) Heard the learned counsel for the petitioner and the learned counsel for the respondent.

(2.) The petitioner who is the defendant before the trial court has challenged the order dtd. 25/11/2017 passed on IA.No.III filed in O.S.No.1052/2017. The said IA.No.III has been filed by the respondent - plaintiff under Order XXVI Rule 9 of the Code of Civil Procedure, 1908 ('CPC' for short) for appointment of Commissioner.

(3.) The respondent/plaintiff has filed a suit for injunction, which is contested by the petitioner/defendant.
