JUDGEMENT

(1.) Heard the learned counsel for the petitioner.

(2.) The petitioner is before this Court impugning the order of the Tribunal dtd. 10/6/2021 rendered in application No.5622/2020 whereby the Tribunal was pleased to uphold the penalty of compulsory retirement imposed upon the petitioner and was pleased to reject the application.

(3.) It is contended by the learned counsel for the petitioner that the Tribunal has failed to appreciate the fact that the Criminal Court has honorably acquitted the petitioner. That the Tribunal has failed to appreciate the fact that there was no work pending before the petitioner and that the Tribunal has also failed to take note of the fact that the money was placed on the table and the petitioner did push it away with the file and did not handle the tainted money. That the Tribunal has also failed to appreciate the fact that the hand wash also did not turn pink and erred in appreciating the material placed before the Tribunal and thus neither the eye witnesses nor the shadow panch have deposed against the petitioner and in fact in the domestic enquiry the complainant has not participated at all and has not deposed against this petitioner.
