JUDGEMENT

(1.) Petitioner - accused No.5 has preferred this petition under Sec. 439 of Cr.P.C. seeking bail in Cr.No.179/2021 of Udayagiri Police station, Mysuru.

(2.) Charge sheet is filed against accused Nos.1 to 13 for offences punishable under Ss. 143, 144, 147, 148, 341 , 323, 354(B), 307, 302 read with 149 of Indian Penal Code .

(3.) The case of the prosecution in brief is that: First informant namely Ibrahim S/o Fayaz Pasha had lost his mobile phone on 14/8/2021. He came to know that the said mobile phone is with one Imran - accused No.1 of Kalyangiri Nagara. Therefore, he went near his house to ask him to return the mobile phone. The said accused told him that he will come near his house and talk. On 15/8/2021, at about 7.30 p.m., accused No.1 came near first informant's house along with other accused persons and all of a sudden started fighting with the first informant. In the said incident, one Mohammed Yaseen, a friend of first informant's brother was stabbed by the accused. Two more persons sustained injuries.
