JUDGEMENT

(1.) This Criminal Revision Petition is filed by the petitioners, being aggrieved by the order dtd. 7/4/2017 in S.C.No.10030/2015 on the file of the Court of the V Additional District and Sessions Judge, Tiptur, wherein the application filed by the prosecution under Sec. 319 of the Code of Criminal Procedure (for short ' Cr.P.C ') was allowed in part with respect to proposed accused Nos.5 to 9 and dismissing the application with respect to proposed accused No.6.

(2.) Being aggrieved by the same, the proposed accused Nos.5 to 9 are before this Court.

(3.) It is the case of the prosecution that, the father of the deceased lodged a complaint before the respondent police on 22/4/2015 at about 12.00 p.m., stating that, the marriage between the accused No.1 and the deceased was performed on 11/4/2012. After marriage, the deceased was staying at her in-laws house. However, the accused No.1 was working at Bengaluru. It is further stated that, during the stay of the deceased in her in-laws house, the husband and in-laws stated to have demanded additional dowry and sent back the deceased to his house. After that, the complainant stated to have sold the land and paid Rs.5,00,000.00 to the husband and in-laws of his daughter. It is further stated that, his daughter gave birth to a male child. It is further stated that, on 21/4/2015, the complainant and his wife had been to the house of the deceased and came back on the same day. However, on 22/4/2015, at about 6.45 a.m., the complainant has received a message that, his daughter died in the matrimonial house. On hearing the news, the complainant and some members of the village had been to the house of the deceased and noticed that, the deceased was killed by the husband and in-laws in connection with dowry. Hence, complaint was lodged against the husband and in-laws of his deceased daughter. In the complaint, the proposed accused were also arrayed as accused. During the investigation, the Investigating Officer found no sufficient allegations and dropped them while filing the charge sheet.
