(1.) This contempt petition is filed alleging disobedience of the order dtd. 10/1/2022 passed by the learned Single Judge in W.P.No.21276/2021.

A detailed order was passed by this Court on 4/8/2023 expressing displeasure over deliberate inaction and manifestation of scant regard to the orders/directions of this Court by the State Authorities. It was observed that the citizens are constrained to approach this Court complaining contempt of the orders/directions of this Court and this attitude on the part of the State Authorities has resulted in accumulation of unwarranted litigations apart from eroding public confidence. Therefore, this Court directed the Tahsildar, Bengaluru South Taluk, Bengaluru, as well as the Assistant Commissioner, Bengaluru South Division, Bengaluru, to remain present before the Court on 17/8/2023. Pursuant to the said order, the Tahsildar and the Assistant Commissioner were present before this Court on 17/8/2023 and at the request of the learned Additional Government Advocate, the matter was directed to be listed on 21/8/2023 as first matter on Board.
(3.) Today also, the Tahsildar and the Assistant Commissioner are present before this Court. The learned Additional Government Advocate has filed an affidavit dtd. 21/8/2023 in Court today. It is stated in paragraph 4 of the affidavit that in pursuance of the direction of this Court dtd. 10/1/2022, the accused have conducted phodi and durast work pertaining to Sy.No.22 of Taralu Village, Uttarahalli Hobli, Bengaluru South Taluk and approved Form No.5 and Form No.10 on 20/8/2023. The copies of Form No.5 and Form No.10 are annexed to the affidavit as Annexures-R.1 and R.2 respectively. Form No.5 is duly signed by the officer concerned and Form No.10 is digitally signed. In paragraph 5 of the affidavit, it is stated that there is some delay in complying with the order passed by this Court which is due to administrative reasons and unconditional apology is tendered for the delay. Thus, the affidavit clearly indicates that if the Authorities discharge their duties in a time-bound manner and act in a reasonable phase, there will be hardly any occasion for the citizens to approach this Court for redressal of their grievances. We hope and trust that the State Authorities would maintain such approach and attitude in future also which would avoid accumulation of unwarranted litigations in this Court.
