(1.) Heard Sri. Sudhirsingh R.Vijapur, learned counsel for the petitioners and Sri. Shambuling S.Salimath, learned counsel for the respondent.
(2.) The petitioners have challenged the order of the Central Administration Tribunal in Original Application No.170/00044/2018. The Tribunal by the impugned order held that the respondent was entitled to MACP-III.
(3.) Respondent pleaded before the Tribunal that he joined the Postal Department as Group-D on 19/7/1975. After passing the examination for recruitment of postmen, he was appointed as postman with effect from 18/9/1979. Thereafter, on being successful in the limited departmental competitive examination, he was appointed as postal assistant in 1983. On completion of 16 years of service as postal assistant, he was given financial up-gradation under TBOP scheme with effect from 6/3/1995. Thereafter, on completion of 26 years of service he was given financial up-gradation under BCR scheme with effect from 1/7/2009. The MACP scheme was introduced with effect from 1/9/2008 and the TBOP and BCR schemes were withdrawn. Though the respondent was entitled to 2nd and 3rd MACP benefits from 1/9/2008 and 13/8/2009 respectively, he was not given the same on the ground that he had got three promotions before the introduction of MACP scheme.
