SAGER AHAMAD Vs. STATE OF KARNATAKA

JUDGEMENT

(1.) Accused Nos.1 to 4 in Crime No.53/2023 registered by M.K.Doddi Police Station, Ramanagara for the offences punishable under Sec. 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, are before this Court seeking regular bail in these two petitions.

(2.) Heard learned counsel for the parties.

On the complaint of Smt.Sneharaj N, in-charge Dy.SP, dtd. 26/6/2023, Station House Officer of M.K.Doddi Police Station, Ramanagara had registered FIR in Crime No.53/2023 against accused Nos.1 and 2 i.e., petitioners in Criminal Petition No.6323/2023. In the complaint, it is averred that the complainant had received a credible information that on Channapatna - Mallanakuppe Road of Bevooru Village, two persons were selling Ganja to the public. Therefore, the complainant raided the spot along with other independent Panchas and apprehended two persons. On interrogation, they revealed their names as Sageer Ahamad @ Kurram and Mahabbad Shaabaz. On inspection, 883 gms of Ganja was found with accused Nos.1 and 2. The same was seized and subjected to Mahazar and thereafter, the contraband articles were seized and accused Nos.1 and 2 were produced before the Police Station and FIR in Crime No.53/2023 was registered against them.
