MUNIYA Vs. STATE

JUDGEMENT

(1.) This petition is filed under Sec. 439 of Cr.P.C. praying to enlarge the petitioner on bail in Crime No.67/2023 of Bylakuppe Police Station, registered for the offence punishable under Sec. 379 of IPC and Sec. 86 and 87 of Karnataka Forest Act, 1963.

(2.) Heard both the sides and perused the material on record.

(3.) The case of the prosecution is that, the PSI of Byalakuppe Police Station received a credible information on 5/5/2023 at about 8.55 p.m. that the petitioner has stored sandalwood pieces behind his house, intending to sell it. On receiving the said information, he along with staff and panchas went near the house of the petitioner and found 11 plastic bags containing small pieces of sandalwood weighing about 240 kgs, in the backside of his house. The said sandalwood pieces were seized under a mahazar in the presence of panch witnesses.
