JUDGEMENT

(1.) Heard Sri. Rajesh Doddamani, the learned counsel for the petitioner and Sri. Sharanabasappa M. Patil, the learned High Court Government Pleader for the respondent - State.

(2.) The complaint came to be registered by the mother of the deceased against the daughter-in-law. It is stated in the complaint that the petitioner married younger son of the complainant 04 years ago and the couple had two children, one male and one female. It is stated that both the husband and the wife were living cordially for 1 1/2 years. Thereafter, there was quarrel between them even for petty reasons. It is stated in the complaint that the complainant used to advise them to live happily. It is stated in the complaint that on 4/2/2018, the complainant came to know that her younger son namely the deceased - Devappa was killed and thrown to the street by tying the dead body in a plastic bag. On receiving the said information, the complainant had been to the place where the dead body was thrown and identified the said dead body as her fourth son and thereafter lodged the complaint suspecting the involvement of the daughter-in-law. The case came to be registered in Crime No.13/2018 for the offences punishable under Ss. 120(B), 302 and 201 read with 34 of Indian Penal Code (for short ' IPC ').

(3.) Sri. Rajesh Doddamani, the learned counsel for the petitioner submits that entire case is based on the circumstantial evidence. There are no eyewitnesses to the incident. The dead body of the deceased - Devappa was found in the street. It was tied in the plastic bag. Nothing has been recovered at the instance of this petitioner. She has been falsely implicated in this case. The petitioner is judicial custody from 5/2/2018. It is further submitted that the petitioner is female and having two children. It is further submitted that, she is permanent resident of Nagarbanda village. The petitioner will abide the conditions which will be imposed by this Court in the event of her release on bail. Making such submission, the learned counsel for the petitioner prays to enlarge the petitioner on bail.
