JUDGEMENT

(1.) These two writ petitions are filed challenging the order dtd. 31/5/2010 passed by the respondent- Land Tribunal, wherein the occupancy rights of the land bearing Block No.39 which totally measures 13 acres 06 guntas of Dharwad village and district was granted in favour of the petitioners in WP No.64840/2010 to the extent of 8 acres 2 guntas and was refused to the extent of 5 acres 4 guntas. WP No.65628/2010 is filed challenging the order of the Tribunal insofar as it relates to granting of occupancy rights, while WP No.64840/2010 is filed challenging the order of the Tribunal insofar as it relates to rejection of the claim in respect of 5 acres 4 guntas.

Learned counsels appearing for the parties jointly submit that the dispute between the parties has been amicably settled and the parties are satisfied with the order of the Tribunal and to put an end to the litigation, they have entered into a settlement and in terms of the same, a petition is also filed under Order XXIII Rule 3 of Code of Civil Procedure read with articles 226 and 227 of the Constitution of India. They have today filed before this Court the said petition under Order XXIII Rule 3 of CPC read with Articles 226 and 227 of the Constitution of India along with survey sketch and the report of the ADLR. The compromise petition is signed by the respective parties and also their advocates. The same is taken on record. Relevant terms of the compromise reads as follows:

(3.) Under the circumstances, I am of the considered view that the writ petitions are required to be disposed of in terms of the aforesaid compromise petition. Accordingly, the following: ORDER
