JUDGEMENT

(1.) This petition is filed under Sec. 439 of Cr.P.C. to enlarge the petitioners/accused Nos.1 and 3 on bail in Crime No.205/2022 of Hanagal Police Station registered for offences punishable under Ss. 395 and 420 of IPC.

(2.) Heard the learned counsel for petitioners and the learned HCGP for respondent-State and perused the material on record.

The case of the prosecution in brief is that, about one month prior, when the complainant had gone to Sultan Batheri, accused No.1 met him and introduced himself as Ramesh Hanagal and while talking, he asked the mobile number of the complainant and also gave his mobile number to him. After one week, he called the complainant and told him that his grand father has about 2 kgs of gold coins and since he has to perform the marriage of his children, he urgently needs a sum of Rs.10,00,000.00 and requested the complainant to purchase the gold coins. On 19/11/2022, the complainant went to Shivamogga along with his friend by name Saiju and on 20/11/2022, he met accused No.1. Along with the said accused, there were other persons as well as a lady who was holding a plastic cover. They informed that they have gold coins with them and gave one gold coin to the complainant. Thereafter, the complainant returned to his village and mobilized Rs.10,00,000.00 and once again went to Shivamogga in Maruthi Suzuki Omni bearing No.KL-12/A-9079 along with his friend Saiju and driver Anisha. On 27/11/2022, when they came near Nalkar cross, Hanagal at 9.20 a.m. accused No.1 called him over phone and asked him to come near the petrol bunk. When they went there, accused No.1 fisted on the chest of the complainant and snatched the bag containing Rs.10,00,000.00 and ran inside the forest. When they tried to nab him, other persons who were along with him and the lady pelted stones at him and threatened that they will kill him, if they tried to catch them.
