JUDGEMENT

(1.) Learned counsel for the petitioners contends that petitioners have purchased the property in question from one Smt. Sugunamma on 22/2/2019. However, an order came to be passed in favour of Smt. Sugunamma in Writ Petition No.105695/2018, wherein this Court granted liberty to the petitioner/Smt.Sugunamma to submit reply to the notice issued by the respondent along with documents, if any and the respondent/Hampi World Heritage Area Management Authority, Hosapete to consider the same and pass suitable orders after giving reasonable opportunity of hearing.

(2.) The petitioners step into the shoes of the vendor namely Smt. Sugunamma, who had already approached this Court in the aforesaid writ petition. Despite the petition being allowed, petitioners have not filed any documents in support of her case. This order pertains to the illegal construction put up in the Hampi World Heritage Area, Hosapete, in which several orders have been passed by the Hon'ble Apex Court including the matter in Sakkubai and Others vs. State of Karnataka and Others , reported in (2020) 11 SCC 124, wherein several illegal constructions and structures constructed in Virupapura Gaddi have been ordered to be demolished. This also appears to be in the very same locality.

(3.) In view of the fact that the petitioner not approached the respondent by furnishing any documents one opportunity deserves to be given. However, same cannot be a ruse for the petitioner to drag on the matter. Petitioner shall file the objections/reply or furnish the necessary documents for having obtained permission/license/authorizations and any legitimate authority from HWHAMA and other authorities for running the home stay resort/resort. Two days time is granted to file the same and approach the 2nd respondent and on consideration of the said documents and verification, respondent No.2 shall pass the suitable orders.
