JUDGEMENT

(1.) This writ petition is filed by the Bharat Sanchar Nigam Limited challenging the order passed by the Central Administrative Tribunal setting aside the order of transfer of the 1st respondent from Bangalore Telecom District to Kolar Telecom District.

(2.) The 1st respondent, B Ramachandra was appointed as Junior Engineer in Telecom Department on 10.8.1981. He was promoted as Sub-Divisional Engineer in 1998 and on regular basis in April, 2000.

(3.) On 2.9.2003, the BSNL issued a notification seeking option for absorption from Group B officers in BSNL. They were required to exercise their option for permanent in BSNL by 20.10.2003. Those who have opted for services under the BSNL were entitled to IDA pay scale and also for time bound advancement on completion of 5 years. The 1st respondent submitted his application giving his option to be absorbed in BSNL.
