JUDGEMENT

(1.) PETITIONERS apprehending their arrest in Crime No.173/2013 registered for the offences under Sections 341, 504, 353, 332, 506 r/w 34 I.P.C., on the file of Saraguru police station, Hunsur are before this court seeking for grant of anticipatory bail.

(2.) IT is alleged that on 19.7.2013 these petitioners had let their cattle for grazing in the reserved forest area situated at Chikkabargi Unit of Hediyala zone. The complainant on noticing the same questioned the accused as to why they have let their cattle for grazing in the reserved forest. In response to the same the petitioners are alleged to have abused the complainant in vulgar language and also have assaulted him with stone on his back and have threatened him with dire consequences.

(3.) LEARNED High Court Government Pleader opposed the application filed by the petitioners. The offences alleged against the petitioners are one under Sections 341, 504, 353, 332, 506 r/w 34 I.P.C. None of the offences are punishable with extreme penalties. The allegation made against the petitioners is that the petitioners had let their cattle for grazing in the reserved forest area coming within the jurisdiction of Chikkabaragi, Hediyala zone and they are alleged to have abused and assaulted the complainant and other officials with stone on their back and threatened with dire consequences. Having regard to the nature of offences alleged, the punishment provided for the same, in the circumstances I do not find any justification to decline the request of the petitioners. Accordingly I proceed to pass the following: - ORDER Petition is allowed. The petitioners in the event of their arrest in Crime No.173/2013 of Saraguru police station, the said police are directed to release them on bail on each of them executing a personal bond in a sum of Rs.25,000/ - with one surety for the likesum to the satisfaction of the said police subject to the following conditions: -
