IN this writ petition, petitioner is seeking a direction to the 1st respondent - Rajiv Gandhi University of Health Sciences (for short, 'the University') to allow her to appear for the 1st year B.Sc. Nursing examination commencing from 04.09.2012 or in the alternative to hold special examination to the petitioner so as to enable her to continue further studies.
(2.) IT is the case of the petitioner that she was admitted to the 2nd respondent - Hillside College of Nursing, Kanakapura Main Road, Bangalore, to pursue the Four Year Course in B.Sc. Nursing for the academic year 2011-12. Annexure-A is the letter dated 25.08.2011 issued by the Administrative Officer of the College informing the petitioner about the confirmation of her admission to the said course. According to the petitioner, though she was found eligible for admission to the 1st year course of B.Sc. Nursing and an regard was issued by the respondent - University as per Annexure-B dated 30.03.2012, the respondent - University has not approved her admission and consequently, she was not allowed to take the 1st year examination which was scheduled to be held from 04.09.2012. This made the petitioner to approach this Court.

LEARNED counsel for the petitioner inviting the attention of the Court to Annexure-B - Eligibility Certificate issued by the Registrar of the respondent - University submits that it is not open for the University to now contend that petitioner was not eligible for admission to the course as she had secured 44.6% of marks in the qualifying examination.
