NAGARAJ Vs. STATE OF KARNATAKA

JUDGEMENT

(1.) This petition is filed by the petitioners under sec. 439 Cr.P.C., who are arrayed as accused Nos.1 and 3 in Cr.No.34/2022 of Navalgund police station, Dharwad registered for the offences punishable under sec. 323, 324, 504, 109, 394, 34 IPC.

(2.) Petitioners were arrested on 8/3/2022. Their bail petition is rejected by learned Sessions Judge, Dharwad. Hence, they have filed this petition.

(3.) It is the case of the prosecution that the first informant by name Gangadhar Mallappa Toravi lodged a complaint against the Tahsildhar- Naveen Hullura, Navalgund to Lokayuktha police, Dharwad alleging that there was scam in distribution of plots. As a result, one Basappa Chawadi and Shankrappa Ramappa Siruguppa of Annigeri village were annoyed and they asked the complainant to take back the complaint, for which, the complainant refused.
