JUDGEMENT

(1.) This petition is filed by the petitioner/accused under Sec. 439 of Cr.P.C., for granting bail in Crime No.134/2022 registered by Yeshwanthpur Police Station for the offence punishable under Sec. 120(B) and 302 read with 34 of IPC of Indian Penal Code .

(2.) Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent-State.

The case of the prosecution is that the complainant Rajashekar has lodged a complaint stating that one Shankar Reddy from Andhra Pradesh has come and occupied his house on rental basis by paying monthly rent of Rs.5,000.00 and advance of Rs.40,000.00. Subsequently, he brought his wife and his two children to the house. On 28/4/2022 at about 10.00 p.m., deceased Shankar Reddy met and return to his house, thereafter the complainant was slept at his house after that at about 12.30 a.m., deceased Shankar Reddy's elder son knock the door of the complainant's house and he was crying then the complainant open the door and asking about the incident and went to Shankar Reddy's house. In the hall, somebody killed the Shankar Reddy by knife and the Hall of the house blooded, deceased Shankar Reddy's wife also fallan beside of Shankar Reddy by unconsciousness and she recovered after 10 minutes and she was shifted to hospital by ambulance. Thus, the complainant sought the respondent police to trace and take a legal action against the murdered. Thereafter, the jurisdictional police registered the case in Crime No.134/2022 for the offence punishable under Sec. 120(B) and 302 r/w 34 of IPC . During the investigation, the police have suspected the wife of the deceased. On enquiry, she told that she was not interest to marry Shankar Reddy. Before her marriage, she was having relationship with accused No.2 i.e Parandama who is the petitioner in this case. The wife of the deceased Shankar Reddy does not want to marry him. Then they have conspired. With the conspiracy of this petitioner, the wife of deceased Shankar Reddy committed the murder of her own husband. Investigation is said to have been completed but the document with regard to the same has not been submitted. The investigation is made only on the basis of FIR. The petitioner has approached the Sessions Court for grant of bail, which came to be rejected. Hence, he is before this Court.
