JUDGEMENT

(1.) Challenging order dtd. 6/6/2022 passed by XV Additional City Civil and Sessions Judge at Bengaluru (CCH-3) (for short 'trial Court') in O.S.no.3275/2022 on I.A.no.1 filed under Order XXXIX Rule 1 and 2 of CPC, this appeal is filed.

(2.) Appellant herein was defendant, while respondent herein was plaintiff. For sake of convenience, they shall hereinafter be referred to by their rank in original suit.

(3.) O.S.no.3275/2022 was filed seeking for perpetual injunction restraining defendant from interfering with suit schedule 'C' property and to restrain him from putting up any construction over suit schedule 'C' property.
