The present Civil Contempt Petition is filed by the complainant to take action against the accused for willful disobedience of the Order dtd. 10/8/2021 passed by this Court in RFA No.225/2021, wherein, the appellant undertook to deposit a sum of Rs.7,00,000.00 without prejudice to all other contentions, within ten days from the date of that order. Since the accused/appellant failed to deposit the said amount within the time stipulated, the complainant/respondent was forced to file the present Civil Contempt Petition on 24/9/2021.
(2.) This Court, by the Order dtd. 1/6/2022, issued emergent notice to accused. When the matter was listed on 16/6/2022, though the accused was represented by learned counsel, none appeared on his behalf. Therefore, bailable warrant was issued to the accused. On 30/6/2022, the accused was present before the Court. Since the Order was not complied with, the Court observed that this is a clear case of contempt and the complainant has made out a case for framing of Charge.
(3.) Today, the matter is posted for framing of Charge. The accused and his counsel are present. Initially, the accused did not report compliance of the Order. Therefore, when the accused was called to the witness box to frame the Charge, he opened a cover and tendered two Demand Drafts, one bearing No.041109 for Rs.5,00,000.00 and another bearing No.041110 for Rs.2,00,000.00 both dtd. 6/7/2022 drawn on HDFC Bank, in favour of the Registrar General, High Court of Karnataka.
