JUDGEMENT

(1.) The instant writ petition is filed by the petitioner who is a BE student studying in college affiliated to respondent No.2. Regulation OB-6.2, 7.1 and 7.2 of respondent No.2 University pertaining to degree for Bachelor of engineering/lateral reads as under:

(2.) Petitioner has failed in several subjects in the previous years' semesters and was not eligible to appear for the 7th semester examination as per afore mentioned University Regulations. However, inadvertently by mistake of college, the petitioner was issued hall ticket and petitioner appeared for 7th semester examination. Pursuant to the same, the results were also announced by respondent No.2 University. However, after realizing the mistake, respondent No.2 University passed an order withdrawing the results of examination conducted in January and February, 2020-21. Aggrieved by the same, the instant writ petition is filed.

The case of the petitioner is that his career has been harmed substantially by pandemic and similarly passed students of other years have been accommodated by University and in the instant case, the petitioner is also permitted to write examination, he has studied and passed in examination, but results have been withheld. In the facts and circumstances of the case, the petitioner is treated unfairly and University ought to have adopted sympathetic approach and should not discriminate against them.
