The petitioner, a retired Head Master of fourth respondent is before this Court praying to set aside the order dtd. 3/2/2015 passed in Appeal No.01/2014 at Annexure-A; to set aside the order passed by the Fourth respondent bearing No.DzÉÃ À 01/PÀ Á 1/2011-12 dtd. 19/1/2012, imposing punishment of censure; and also for a direction to release the balance salary and other consequential benefits for the suspension period from 7/8/2008 to 3/10/2010 with interest.
(2.) Heard the learned counsel Sri.Mohan.B.K., for the petitioner through video conference, learned Additional Government Advocate Sri.M.V.Ramesh Jois for respondent Nos.1 to 3 and Sri.Manjunatha.L.S., for respondent No.4. Perused the writ petition papers.
(3.) Learned counsel for the petitioner would submit that the petitioner was working as Head Master at the fourth respondent - Institution. When he was working as Head Master, he was kept under suspension on 7/8/2008. Thereafter, the suspension was revoked on 3/10/2010. Subsequently, the petitioner retired on attaining the age of superannuation on 31/7/2012. It is submitted that the fourth respondent - Institution initiated enquiry against the petitioner and after conducting detailed enquiry, by order dtd. 19/1/2012, imposed punishment of censure and the same was communicated to the competent Authority. Thereafter under Annexure-C, letter dtd. 19/1/2012, on the same day of imposition of punishment, the fourth respondent - Institution addressed a letter to the third respondent to drop the departmental proceedings and to treat the suspension period as on duty. The said proposal was forwarded by the third respondent to the second respondent. The second respondent under Annexure-E, closed the file. Thereafter, the petitioner is said to have filed appeal before the second respondent. The second respondent under Annexure-A order dtd. 3/2/2015, rejected the appeal of the petitioner and confirmed the communication dtd. 19/7/2013.
