(1.) The petitioners-accused Nos.2 and 3 are before this Court seeking grant of anticipatory bail in Crime No. 63/2022 of Shahapur Police station, registered for the offences punishable under Ss. 143, 147, 148, 323 , 324, 307, 504, 506 read with sec. 149 of Indian Penal Code (for short ' IPC '), on the basis of first information lodged by the informant-Tayamma.
(2.) Heard Sri S.B.Sangolagi, learned Counsel for the petitioners and Sri Shivakumar R. Tengli, learned Additional Government Advocate for the respondent-State. Perused the materials on record.
(3.) Learned Counsel for the petitioners submitted that petitioners are arrayed as accused Nos.2 and 3. They have not committed any offence as alleged. They have been falsely implicated in the matter without any basis. The co-accused are already enlarged on bail. It is alleged that accused No.2 assaulted Ningappa with a stick and accused No.3 assaulted one Mareppa on his head. Both these injured have already been discharged from the hospital. Wife of accused No.1 filed a complaint against the informant and other witnesses in the present case. So there is case and counter case against each other. There is delay of more than two days in filing the first information. The petitioners are not required for interrogation. They are the permanent residents of the addresses mentioned in the cause title to the petition and they are ready and willing to abide by any of the conditions that would be imposed by this Court. Hence, he prays to allow the petition in the interest of justice.
