The petitioner, an employee of second respondent - Bangalore University Employees House Building Co- operative Society Ltd., is before this Court praying to quash Annexure-K wherein the Society has invited the applications to fill up the post of Secretary and one post of Clerk-cum-Typist and for a writ of mandamus to consider the petitioner's case for compassionate appointment.
(2.) Heard the learned counsel Sri.Gireesha Kodgi for the petitioner as well as learned High Court Government Pleader for respondent No.1 - State. Perused the writ petition papers.
(3.) The petitioner is claiming compassionate appointment in the second respondent - Bangalore University Employees House Building Co-operative Society Ltd. The second respondent is not a State within the meaning of Article 12 of the Constitution of India. Learned counsel Sri.Gireesha Kodgi submits that the second respondent - Bangalore University Employees House Building Co-operative Society Ltd., is controlled by the first respondent - State, but there is no material on record to establish the control of the State Government over the second respondent - Bangalore University Employees House Building Co-operative Society Ltd. Moreover, there cannot be State control over a House Building Co-operative Society Ltd. Since the second respondent is not a State, I decline to entertain the writ petition. It is open for the petitioner to workout remedy available under law. Accordingly, writ petition is disposed of.
