The petitioner-Advocates Association, Bengaluru has sought for issuance of writ of mandamus to the respondent Nos.1 to 3 to consider the representation made by the petitioner at Annexure-'D' dtd. 27/6/2022 and has sought for similar consideration of the representation at Annexure-'E' dtd. 24/6/2022 and has also sought for direction to follow the Karnataka Judicial Service (Recruitment) Rules, 2004 and the Amendment Rules 2011, 2015 and 2016.
(2.) At the time of hearing of the matter, one of the principal contention advanced was that the candidate for Viva-voce must be called in the proportion of 1:3. As regards such contention, it is contended by learned Senior Counsel appearing on behalf of the respondents that in terms of sub-rule (3) of Rule 5 of the Karnataka Judicial Service (Recruitment) Amendment Rules 2016, the candidates have been called for Viva-voce in the proportion of 1:3 as regards each of the reservation category and accordingly, there is no infraction on that ground. The list of candidates from various categories who have been called for Viva-voce in the proportion of 1:3 has been indicated in the Table filed alongwith the memo dtd. 13/7/2022. The same is extracted hereinbelow:-
(3.) Insofar as Annexure-'F' dtd. 4/8/2021 is concerned, it is pointed out that there has been some shuffling of the categories. Learned Senior Counsel appearing for the respondents submits that it is only insofar as horizontal reservation there has been some adjustment, which is as per the applicable Government Orders, but altering the vertical reservation does not arise. Accordingly, this Court finds no reason to interfere with the selection process.
