JUDGEMENT

(1.) The petitioners-accused Nos.1 to 6 are before this Court seeking grant of anticipatory bail in Crime No.24/2022 of Kushnoor Police Station, Bidar, registered for the offences punishable under Ss. 302 , 506 read with Sec. 149 of IPC, pending on the file of Senior Civil Judge and JMFC Court, Aurad, on the basis of first information lodged by the informant-Shivanad.

(2.) Heard Sri. Sanjay Kulkarni, learned counsel for the petitioners and Sri. Gururaj V.Hasilkar, learned High Court Government Pleader for the respondent-State. Perused the materials on record.

(3.) Learned counsel for the petitioners submitted that the petitioners are arrayed as accused Nos.1 to 6. They are innocent and law abiding citizens. They have not committed any offence as alleged. They have been falsely implicated in the matter without any basis. They are having reasonable apprehension of being arrested and therefore, they are before this Court. The informant is the son of the deceased-Nagashetti Dabale, filed first information without there being any basis and only to implicate the petitioners in the matter. Simply because the dead body of the deceased-Nagashetti Dabale was found, FIR came to be registered against these petitioners and subsequently, further statement of the informant and statement of wife of the deceased were recorded by the Investigating Officer and also their statements were recorded under Sec. 164 of Cr.P.C., before the learned Magistrate, where both the witnesses have categorically stated that the deceased died by committing suicide and nobody assaulted him or caused his death. Therefore, there are absolutely no materials against these petitioners to connect them to the offence in question. They are the permanent residents of the address mentioned in the cause title to the petition and they are ready and willing to abide by any of the conditions that would be imposed by this Court and will co-operate with the Investigating Officer and assist in the investigation. The petitioners are not having any criminal antecedents. Hence, he prays to allow the petition in the interest of justice.
