JUDGEMENT

(1.) The petitioners, in these petitions, are before this Court calling in question proceedings in C.C.No.1024/2021 registered for offences punishable under Ss. 498A , 323, 504, 506 r/w Sec. 34 of the IPC and Sec. 4 of the Dowry Prohibition Act, 1961, pending before the JMFC (III Court), Mangaluru, D.K. arising out of Crime No.56/2020.

(2.) During the pendency of this petition, the parties to the lis i.e., husband and wife have arrived at a settlement before the family Court in M.C.No.325/2021 and a copy of memorandum of settlement filed under Sec. 89 of the CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2007 is also filed before this Court. The learned counsel for respondent No.2 would submit that the conditions stipulated in the settlement have been fulfilled between the parties.
