RATHNAMMA Vs. DEPUTY COMMISSIONER MANDYA DISTRICT

JUDGEMENT

(1.) The 1st petitioner - Rathnamma is the daughter of Basavalingaiah.

(2.) Basavalingaiah had five children namely Basavaiah, Rathnamma (1st petitioner), Nagamma, Gowramma (mother of respondents 5 and 6) and Shanthamma (respondent No.4).

(3.) Rathnamma, Gowramma and Shanthamma instituted a suit for partition in O.S.No.788/1989 in respect of five items of agricultural lands. The suit had been instituted against their brother Basavaiah and another sister Nagamma (who was initially a plaintiff but was later transposed as defendant No.2).
