This petition is filed by Accused No.1 under Sec. 439 of Cr.P.C. for enlarging them on bail in Crime No.170/2022 of Marathahalli Police Station, Bengaluru City, registered for the offences punishable under Ss. 8(c), 22(c), 27(a), 20(ii)(b), 23(b), 23(c) and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 ( 'NDPS' Act' for short), pending on the file of the Metropolitan Magistrate (MMTC-I), Mayo Hall, Bengauru.

The brief factual matrix of the prosecution case are that, on 28/7/2022 at 4.45 p.m., the complainant has received a credible information regarding some persons involving in drug trafficking through courier and postal services and storing Narcotic Drugs in their room. Then, the complainant informed the same to his Higher Officers and obtained permission to conduct a raid. Thereafter, along with his staff and panchas, he went to the spot and conducted raid in Room No.406, Zolo Laurel-A No. 89/1, 4th Floor, 3rd Cross, Veerappa Reddy Layout, Munnekolala, Bengaluru - 560 037, and wherein he found presence of petitioner including five other persons and he ascertained their names. During search of said room, he found storage of 10 MDMA Ecstasy Tablets weighing 4.03 grams, LSD Strips 20 weighing 0.33 grams and 01 Kg 200 grams Ganja. The complainant has drawn a detailed mahazar in presence of the panchas. Then, it is also revealed that the present petitioner and other accused used porter and Dunzo Apps delivery boys to transport the said Narcotic Drugs by wrapping them as gift parcels to the college students and IT/BT employees. After seizure, the complainant prepared a report and submitted to the SHO. On the basis of the said report, the said crime came to be registered against the petitioner and other persons. In that context, the petitioner was apprehended and produced before the learned Magistrate and later on, he was remanded to judicial custody.
