JUDGEMENT

(1.) The petitioner filed a suit in O.S.No.140/2003, which was dismissed for non prosecution on 16/8/2005.

(2.) As a consequence, a petition for restoration in Miscellaneous Case No.32/2005 was filed on 30/9/2005.

(3.) However, this Miscellaneous Case No.32/2005 was withdrawn reserving liberty to file a fresh miscellaneous petition.
